On August 25th, 2024, at approximately 10:30 P.M., Officer Marta conducted a motor vehicle stop for a vehicle with equipment violations. While speaking with the driver, Officer Marta detected an odor of alcoholic beverage emanating from his breath. Officer Marta had the driver, a 51 year old male from Caldwell, NJ, step out so that he could perform field sobriety tests to determine if he was safe to operate a motor vehicle. Detective Berger administered the tests and determined that the driver could not operate a motor vehicle safely. He was placed under arrest for driving under the influence and transported back to police headquarters. Once in headquarters, the driver provided samples of his breath for the purpose of testing. It is alleged that his blood alcohol content was above the legal limit. He was issued motor vehicle summonses for driving under the influence, maintenance of lamps and reckless driving. These charges are merely allegations and the driver is presumed innocent until he is found guilty in a court of law.
